          The CHQ has issued notice on 20.11.2016 [Published in our CHQ websites]  for Central working committee meeting on 17.03.2017 [Friday] & All India Conference on 18.& 19.03.2017 [Saturday & Sunday] . The 31st  ALL INDIA CONFERENCE [AIC] of our union will be held at Akhil Bgarathiya Vaishnav Brahmin Bhavan , Aiwam Shaikshanik Trust , Pushkar, Budha Pushkar Road, Pushkar,[Ajmeer] Rajastan – 302022.  Meeting will commence at 10.00 A.M. sharp under the Chairmanship of Shri R.K.Tandon, President of the Union.




DONATION TO MEET  EXPENSES OF KOLKATA CAT CASE  FOR CLAIMING ORGANIZED AUDIT ACCOUNTS CADRE
                The West Bengal Circle has filed court case in Kolkata CAT on Vide  OA No. 350 / 00145  /2017 for claiming ORGANIZED AUDIT ACCOUNTS CADRE to SBCO staff. The Seventh CPC has not considered our demand for Audit status to SBCO staff. As such, we are compelled to file the case in Court. If we succeed in the said case, our disciplinary authority will be changed and our most of the problems will be automatically solved. All Circle  Secretaries/members are therefore requested to donate generously to the said case. Copy of the Petition has already been sent  vide Speed post No. EW392074583 IN   and No. EW392074570  In Dated 03.02.2017  to  Secretary to the Govt. of India, Ministry of Finance , Deptt. of Expenditure, North Block, New Delhi-110001 and Secretary , Ministry of communication & information Tecnology , Deptt. of Posts, Dak Bhawan, New Delhi-110001.

Initial contract with Rs. fifty thousand has been made  between the AISBCE Union and the  Sr. Lawyer Shri  Kalyan Sarkar , of High Court / CAT, Calcutta.  Overall expenditure may be more than one Lakh. We are 100% confident of a favourable order .The petition is in continuation of our original application NO. 793 of 2006  and CAT , Calcutta order Dated 11.01.2008 , 7 CPC  Gazette notification Dated 09.09.2015  and our continuous appeal to the Secretary Posts  through Memorandum .

We must be declared as Auditor P& T Audit not PA(SBCO) . We must be come out from the control of Postmasters/ SSPOs/SPOs to perform properly. 

All Circle  Secretaries/members are therefore requested to donate generously to the said case. Sir/Madam,
                Kindly find enclosed herewith copy of this union letter No. AISBCEU/Time factor for SBCO CBS work/81-2016 dated 08.10.2016 and ADG (SR & Legal) letter No. 10-12/2016-SR dated 31.10.2016 on the subject mentioned above.

                After CBS the work procedure of SBCO has been changed. There is also acute shortage of staff in SBCO due to retirement and non filling of vacant posts. Some of the SBCOs are running in single or double handed. The CO/Divisional Heads are also not providing staff assistance to SBCO as directed by DDG (FS) in Addendum II of SB Order No. 14/2015. Therefore the work of SBCO in all the circles is lagging behind as earlier. The exact justification of staff in each SBCO cannot be calculated as the time factor in CBS environment is not fixed yet.

                It is therefore requested to take immediate action to provide time factor to SBCO work as directed in SR section letter mentioned above. Copies of the above letters are attached herewith for ready reference.

RE-CONSIDERATION OF BCR PROMOTION ON PAR WITH  JUNIORS BY THE DIRECTORATE AS PER THE HON'BLE SUPREME COURT'S ORDER DATED 13.02.2017 INI.A.NO.2,3,412016 IN SLP NO.35654/2015
Dear Comrades,
The Department issued orders for the  Modifications of TBOP/BCR Scheme vide  D.G. Posts letter No. 22-5/95-PE-l dated 8.2.1996 & 26.3.1996 that all the officials such as, UDCs in the Circle Office and SBCO, LSG (both l/3rd and 2/3rd), P.O. and R.M.S. Accountants, whose seniority was adversely affected by implementation of BCR scheme placing their juniors in the next higher scale of pay will now be considered for next higher scale of pay from the date their immediate juniors became eligible for the next higher scale.
                Latter on, the Department issued orders Vide D.G Posts letter No. 22-6/2000-PE.I dated 17.5.2000 that Completion of 16/26 years of service is a must for promotion under TBOP/BCR Scheme.
                Now, the Directorate is seeking information from al Circles to reconsider the BCR promotions on par with the juniors as per the Directorate order given below.
All Circle Secretaries are requested to have a touch with your Circle office and  review the gradation list issued on or after 2000 to 2008 until the introduction of MACP. Subject:- Revision of guidelines for considering placement under TBOP/BCR Scheme in cases where seniors are considered for placement at par with their juniors - regarding.
Sir/Madam,
As per the Hon'ble Supreme Court's Order dated 13.02.2017 inI.A.No.2,3,412016 in SLP No.35654/2015 this Department is to review the Directorate's Order No.22-6/2000-PE dated t7 /5/2000 for extending benefit to seniors for grant of Second financial upgradation i.e. BCR w.e.f. on par with juniors who got higher pay scale after completion of 26 years of service. In this connection, the following information is required on urgent basis:-

Number of senior SBCO employees who were not granted financial upgradation under the BCR Scheme on account of non completion of 26 years whereas their juniors were granted financial upgradation under BCR scheme after completion of 26 years.

In such case, if all the senior SBCO employees are granted financial upgradation under BCR scheme w.e.f. the date of their juniors were granted BCR, what will be the total  fi nancial implications thereof.


2. lt is reiterated that as per the direction of the Hon'ble Supreme Court the entire exercise is to be completed in a TIME BOUND manner. It is therefore, requested that the above information may please be sent by return FAX or email adgestt@indiapost.gov.in  in any case latest by 20.02.2017.

It is the great victory of AISBCE Union. In 2003, our then Circle Secretary Ranjit Kusum Chowdhury  filed a petition  before the CAT Calcutta vide OA No.1148 of 2003 Ranjit Kusum Chowdhury & Ors. Vs Union of India  to extend promotion with reference  to Junior Smt. Aruna Banerjee  / Smt Uma Biswas  . CAT, Calcutta allows the benefit to the Applicants. DOP filed petition against the order before the Calcutta High Court  and subsequently before the Supreme court. Our Advocate Shri Subrata Talukder ( Now Hon'ble  Justice  Calcutta High Court ) pleaded the case in both  High Court and Supreme Court . We spent some lakhs of Rupees to achieve our goal.  In 2010 Supreme Court allows the promotion with reference to Junior. A large no. of Senior SBCO staff under W.B. Circle have already availed the benefits. The rest of the SBCO staff under the Circle will be allowed TBOP / BCR promotion with reference to their junior vides Directorate’s order NO.22-6/2000-P.E. I (Pt.) Dated 16.02.2017.
